Terms and Conditions

These terms and conditions ("Agreement") set forth the general terms and conditions of your use of the elenore.io app and website ("Website"), the Elenore mobile application ("Mobile Application"), and any related products and services (collectively, "Services"). This Agreement is a legally binding contract between you ("User," "you," or "your") and Elenore Inc. ("Elenore," "we," "us," or "our"). By accessing and using the Services, you acknowledge that you have read, understood, and agree to be bound by this Agreement.

If you are entering into this Agreement on behalf of a business or legal entity, you represent that you have the authority to bind such entity. If you do not agree to these terms or lack authority to accept them, do not use the Services.

Accounts and Membership

You are responsible for maintaining the security of your account and are liable for all activities under it. We may review new accounts before granting access and reserve the right to suspend or delete any account for violations or behavior that could harm our reputation. Unauthorized access or providing false information may result in termination. Deleted accounts cannot be reinstated.

Billing and Payments

You agree to pay all applicable fees in accordance with your subscription plan. Subscriptions auto-renew unless canceled before the next billing cycle. Refunds are only available within 14 days of the initial subscription purchase. No refunds are issued for renewals. Monthly subscription plans include usage credits: Basic ($10), Pro ($25), Premium ($40). Overage charges will apply beyond these limits.

In high-risk transactions, we may request a valid government-issued ID and bank statement. We reserve the right to modify pricing and refuse orders at our discretion.

Upon cancellation, accounts remain active through the end of the billing period. Data will be permanently deleted 12 months post-cancellation. Contact [email protected] for cancellations.

Use Restrictions and Transfer Limitations

Accounts and system access within Elenore are non-transferable and may not be exported, shared, or duplicated by or for any other Go High Level (GHL) agency or external provider. Users may not:

Transfer accounts or data to another GHL instance.Provide external agencies or developers access to Elenore’s backend.Clone or replicate Elenore’s funnels, automations, workflows, or designs.

Elenore’s system design and proprietary tools are protected intellectual property. Violations will result in termination and potential legal action.

Ownership of Data and IP

Users retain ownership of customer contact data entered or generated within Elenore. However, all systems, workflows, layouts, templates, and proprietary assets remain the intellectual property of Elenore Inc. Use of Elenore templates is licensed within the platform and may not be used elsewhere.

Third-Party Services

Elenore is powered by third-party infrastructure. We are not liable for any technical issues or data handling policies of these third-party services. Your use of such services is governed by their respective terms.

By enabling third-party integrations, you authorize us to share data as necessary for functionality. You assume full responsibility for the risks and legal compliance of using third-party platforms.

Accuracy of Information

We do not guarantee the completeness or accuracy of content on our Services. We reserve the right to correct errors and change information or cancel orders without notice. Users should not rely solely on the content provided.

Intellectual Property

All content, workflows, designs, trademarks, and templates provided by Elenore remain our intellectual property. Use of the Services does not grant you any license or ownership rights outside of the platform.

Customer Data Ownership and Use

You retain all rights and ownership of your data and any content you store or manage within the Elenore platform (“Customer Data”). Elenore does not access, review, or use Customer Data for its own business purposes, except as necessary to provide and maintain the Services, troubleshoot technical issues, comply with legal obligations, or as otherwise expressly authorized by you. We do not sell, share, or otherwise use your Customer Data for marketing or competitive purposes.

Prohibited Uses

You may not use the Services for unlawful or abusive purposes, including but not limited to:

Violating laws or regulationsInfringing on intellectual property rightsTransmitting malicious codeHarassment, discrimination, or defamationCircumventing security measures

We reserve the right to terminate access for any violations.

Disclaimers

The Services are provided "as is" without warranty. We disclaim all implied warranties, including fitness for a particular purpose. We do not guarantee uninterrupted or error-free service. You use the Services at your own risk.

Limitation of Liability

To the maximum extent allowed by law, Elenore shall not be liable for indirect, incidental, or consequential damages. Total liability is limited to the amount paid by you in the one month preceding the claim or $1, whichever is greater.

Indemnification

You agree to indemnify and hold harmless Elenore from any claims, damages, or expenses arising from your use of the Services, violation of this Agreement, or your content.

Severability

If any part of this Agreement is found invalid, the rest shall remain in effect. The provisions will be limited only as necessary to be enforceable under applicable law.

Governing Law and Dispute Resolution

This Agreement is governed by the laws of Delaware, United States. Any legal action shall be brought in the courts of Delaware. You waive your right to a jury trial. The UN Convention on Contracts for the International Sale of Goods does not apply.

Changes to These Terms

We may update these terms at any time. The revised version becomes effective upon posting unless otherwise stated. Continued use of the Services constitutes acceptance of the changes.
